Terms of Service
Ownership & Licensing
All preparation materials, sketches, visuals, Raw Footage (including unedited video clips and project files), and electronic working files created during the project remain the exclusive property of David Cox (4Adventure Media). Ownership and a perpetual license for the final, edited Work Product transfers to you only after full payment for the applicable service period has been received. Ownership of the final deliverables transfers to you only after full payment has been made. You are fully responsible for ensuring that your company, product, or project name is legally available before work begins. Any legal issues related to the name after project completion are your responsibility. Name changes mid-project are costly, difficult to implement, and may require adjustments to the project fee.
Fonts, typefaces, or other graphic assets used in deliverables are subject to commercial licensing laws. I will provide information about the assets used and where they can be obtained, but securing licenses is the client’s responsibility. I cannot legally provide copies of fonts or assets that I own. All concepts, sketches, visuals, and unused footage remain my property and may be reused in future projects, provided they are sufficiently different from your final deliverables. You may modify the final approved deliverables at your own risk. Unless otherwise agreed in writing, I reserve the right to showcase final designs, photos, or videos in my portfolio, online galleries, awards submissions, or printed materials. Supporting assets may also be used for personal or professional purposes.
Payment
I may request a 50% deposit before starting work. Payment of this deposit constitutes agreement to these Terms. The remaining balance will be invoiced prior to delivery of final files and may be withheld until full payment is received. If you are unresponsive for more than 30 days, I reserve the right to invoice earlier than planned. Payment plans may be requested and will be accepted at my discretion, provided both parties agree in writing. All invoices are due within 30 days of issue, and I reserve the right to charge for any collection fees incurred for overdue accounts.
Project Changes & Cancellation
If you choose to cancel the project after ideas, proposals, footage, or photo proofs have been delivered, payments made to date are non-refundable. Depending on work completed and the overall project budget, a partial refund may be issued at my discretion. If I am unable to complete the project due to illness or unforeseen circumstances, a portion of the fee will be returned, typically in full. Completed work that can reasonably be used by another designer or editor will adjust the refund fairly.
I reserve the right to suspend or terminate a project if progress is disrupted by excessive micromanagement, lack of trust, or delayed payment. Reasonable notice and an opportunity to resolve issues will be provided before any suspension or termination. No refunds will be issued in such cases, and all work produced remains the property of David Cox (4Adventure Media).
Legal & Liability
I cannot provide trademark, copyright, or legal name search assistance. If you wish to register a design, photo, or video as a trademark, you must obtain your own legal advice. You agree that I am not responsible for any loss or damage arising from your use of my services, including reliance on designs, information, video, photography, or third-party content.
All deliverables are original to the best of my knowledge. Limited checks are performed, such as WIPO searches or reverse image searches, but you are responsible for additional due diligence regarding originality. Clients must secure all necessary releases for models, property, or locations used in photography or video. I assume no legal responsibility for missing releases.
In the event I am unable to perform obligations due to acts of God, government action, terrorism, riots, war, accidents, shortages, or other causes beyond my control, this will not be considered a breach of these Terms. You will be notified of the situation, and I will resume work as soon as possible.
